Updated with link to opinion – Breaking: Court denies preliminary injunction in the Doe case

I haven’t had a chance to read the opinion yet and won’t until late tonight or tomorrow. But, given the interest, I wanted to post it so that those who are interested can read it.

I’m told that the judge in the pending case challenging the set back of the midshipman found to have committed sexual assault has denied the motion for preliminary injunction. A written opinion is to be issued tomorrow. Unless the court stays its order to allow an appeal or the midshipman gets a stay from the U.S. Court of Appeals for the Second Circuit, that should mean that he will have to leave the campus until the third trimester of next year, at which time he will rejoin the Regiment, and if he successfully completes his studies and passes the USCG license exam, graduate.
